The Affordable Care Act (Model Notices that Must Be Provided to all Employees by October 1)

Posted on Tuesday, September 17, 2013

The Affordable Care Act (ACA) mandates all employers notify all employees of the new health insurance exchange (aka marketplace) coverage options.

In an effort to assist you in complying with this federal mandate, attached are the model notices which you must provide to all employees by October 1, 2013.

You must give this notice to ALL employees, FT, PT, those currently enrolled, not currently enrolled, and any/all that might currently be insured on your plan under COBRA. Additionally, beginning October 1, 2013, this notice must be distributed to each new employee within 14 days of their date of hire.

Notice is NOT required for dependents or other individuals who are not employees, even if they are currently insured or may become eligible for coverage under the plan. More information on the notice requirement is available at the US Dept. of Labor .

Information is not yet available about plans/rates for 2013. As soon as definitive information is available, it will be forwarded and we will assist you in any way possible in securing coverage either on or off the exchange.

  • Model Notice for Employers Who Do Not Offer a Health Plan
The legislation states notice may be given via first class mail, or electronically if certain conditions are met. However, if you are found to be non-compliant you could be assessed a $100.00/day penalty, so we recommend you have employees sign something indicating their receipt of this notice.

Information is not yet available about the chambers' small group plans/rates for 2014.  As soon as definitive information is available, it will be forwarded and Catherine, your Benefits Administrator, will assist members  in any way possible in securing coverage either on or off the exchange.
