IMPORTANT COBRA INFORMATION
As you have no doubt heard or read, the American Recovery & Reinvestment Act of 2009 (ARRA) includes a provision for a possible 65% subsidy for nine (9) months of COBRA premiums for all employees who may have been involuntarily terminated (laid off or fired) since September 1, 2008.
Employers with over 20 employees, subject to federal COBRA, will be responsible for providing a subsidy of up to 65% of the premium for eligible individuals and/or their dependents, and can take a credit for that payment when they submit their payroll taxes. If the credit exceeds their total federal payroll tax, the company will be reimbursed by the U.S. Treasury. For employers of less than 20 employees, subject to NYS COBRA, the employee or other family member pays 35 percent of the cost but for this temporary subsidy program, the insurance carrier providing coverage under the group insurance program will get the tax credit.
There are some steps you must take right now: Ø Pursuant to this provision all employees must have a new COBRA offering, even if they have already elected continuation of coverage under COBRA. Ø You must - BY APRIL 18TH - send notices to all employees who were involuntarily terminated (laid off or fired) between September 1, 2008 through the current date advising them of this new entitlement. To do so, use the Dept. of Labor Subsidy Notification form which you can access at this link: http://www.dol.gov/ebsa/COBRAextendedelectionperiodnotice.doc Ø Refer individuals interested in learning whether or not they are eligible for the subsidy to the U.S. Department of Labor at 866-444-3272. More information is available in this publication or contact the
U.S. Dept. Of Labor at 1-866-444-3272.
